Cancellation Policy

Hold Harmless, Waiver of Liability, and Assumption of Risk By renting, using, or participating in any equipment, services, or activities provided by Land and Water Recreation Co., including but not limited to golf carts, pontoon boats (with or without a captain), bicycles, tandem bicycles, and access to public or private amenities such as beaches, pools, hot tubs, and similar facilities (collectively, the “Activities”), the undersigned (“Participant”) acknowledges and agrees to the following: Participant understands and acknowledges that participation in the Activities involves inherent risks, including but not limited to bodily injury, property damage, accidents, drowning, collisions, equipment malfunction, negligence of others, and exposure to natural elements. Participant voluntarily assumes all such risks, whether known or unknown. Participant agrees to release, waive, discharge, and hold harmless Land and Water Recreation Co., its owners, officers, employees, agents, contractors, affiliates, and representatives from any and all claims, demands, damages, losses, liabilities, or causes of action arising out of or related to participation in the Activities, including those caused by the negligence of Land and Water Recreation Co., to the fullest extent permitted by law. Participant further agrees to indemnify and defend Land and Water Recreation Co. against any claims brought by third parties arising out of Participant’s use of the equipment or participation in the Activities. Participant acknowledges responsibility for the proper and safe use of all rented equipment and agrees to comply with all applicable laws, rules, and safety guidelines, including but not limited to operating watercraft and vehicles in a safe and lawful manner. If the Participant is signing on behalf of a minor, the undersigned parent or legal guardian agrees to all terms herein and accepts full responsibility for the minor’s participation and any associated risks. Participant acknowledges that access to certain amenities (including beaches, pools, and hot tubs) may be owned or operated by third parties, and Land and Water Recreation Co. is not responsible for the condition, maintenance, supervision, or safety of such facilities. By checking this box, Participant acknowledges that they have read, understood, and voluntarily agree to be bound by this Hold Harmless, Waiver of Liability, and Assumption of Risk Agreement.
